End-User License Agreement (EULA) of Automotion

This End-User License Agreement (“EULA”) is a legal contract between you (either an individual or a single entity) and Automotion Technologies (“Company”, “we”, “us”, or “our”) governing your use of the Automotion web-based software and services described below (“Software”), including any updates, enhancements, add-ons, modules, mobile and web versions, APIs, and support services.

By accessing, installing, or using the Software, you agree to be bound by this EULA. If you do not agree to the terms of this Agreement, do not use or access the Software.


1. Definitions

Software means Automotion’s automation and chatbot builder platform, including all components, features, modules, updates, documentation, and related services that you access via the website https://automotion.10g8.com. 

User means the individual or legal entity that uses the Software under these terms.


2. License Grant

Subject to your compliance with this EULA:

  1. The Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software for your internal business purposes.

  2. You may access and use the Software via supported browsers or platforms as allowed by the Company.

  3. You may invite users under your account (e.g., team members) but you remain responsible for their compliance with this EULA.


3. Restrictions

You agree not to:

a. Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works from the Software, except to the extent permitted by applicable laws, regardless of whether the Company states otherwise.

b. Copy, reproduce, distribute, sell, resell, rent, lease, sublicense, or otherwise exploit the Software for commercial advantage or monetary compensation outside the scope of your license.

c. Allow any third party to access or use the Software on your behalf except as permitted under your account.

d. Use the Software in violation of any applicable law, rule, or regulation.

e. Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.) on the Software.


4. User Accounts & Credentials

  1. You must provide accurate registration information.

  2. You are solely responsible for maintaining the confidentiality of your account, passwords, and security credentials.

  3. You agree to immediately notify the Company of any unauthorized use of your account.


5. Data & Privacy

By using the Software, you agree that the Company may collect and use data as described in the Privacy Policy available at https://automotion.10g8.com/privacy.

Your use of the Software may process your data and the data of your end users, and you represent and warrant that you have all rights and consents to provide such data for processing. 


6. Intellectual Property

  1. The Company and its partners retain all rights, title, and interest in and to the Software, including all intellectual property rights.

  2. The Software is protected by copyright, trademark, and other proprietary rights.

Nothing in this EULA grants you ownership of any intellectual property rights in the Software.


7. Updates & Changes

The Company may provide upgrades, updates, patches, or enhancements to the Software at its discretion.

Use of such updates is governed by this EULA unless accompanied by a separate license.


8. Term & Termination

  1. This EULA is effective upon your first use of the Software and remains in effect until terminated.

  2. The Company may terminate this EULA if you violate any term herein.

  3. Upon termination, you must stop using the Software and destroy all copies of any associated materials.

  4. Sections that by their nature should survive termination (e.g., Intellectual Property, Liability) shall survive.


9. Warranty Disclaimer

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE.


11. Governing Law

This EULA shall be governed by and interpreted in accordance with the laws of [Your Country/State] without regard to its conflict of laws principles.


12. Entire Agreement

This EULA constitutes the entire agreement between you and the Company regarding the Software and supersedes all prior or contemporaneous agreements.
